These Terms & Conditions (“Terms”) are a binding agreement between you and Milcko, operated by Milcko Enterprises, Cabin 02, Kalchuri LNCT Incubation Centre, LNCTE Building, Raisen Road, LNCT Campus, Bhopal, Madhya Pradesh, India (“Milcko”, “we”, “us”). They govern your use of the Milcko customer app, the Milcko Partner app, and this website (together, the “Platform”).

By creating an account or placing an order, you accept these Terms. If you do not accept them, do not use the Platform.

1. Eligibility

You must be at least 18 years old and legally capable of entering into a contract under the Indian Contract Act, 1872 to use Milcko. By using the Platform you confirm that you meet this requirement and that the information you provide is true and current.

Milcko currently delivers only within selected areas of Bhopal, Madhya Pradesh, India. Serviceability is decided by your delivery PIN code and address. We may add, change or withdraw areas at any time without notice.

Milcko operates on cash on delivery (COD). Pay the exact amount shown in the app to the delivery partner at handover. Ask for confirmation in the app once paid. We do not collect card, UPI or banking credentials from customers. Repeated refusal to pay for delivered orders may result in account suspension.

10. Intellectual property

The Milcko name, logo, app design, artwork, text and software are owned by us or our licensors and protected by Indian and international intellectual property law. You get a limited, personal, non-transferable, revocable licence to use the apps for their intended purpose. You may not copy, modify, distribute or create derivative works from them.

Content you submit (reviews, photographs, feedback) remains yours, but you grant Milcko a non-exclusive, royalty-free licence to use it in connection with operating and promoting the service. Do not submit content you do not have the rights to.

11. Third-party services

The Platform relies on third-party services such as Google Firebase, Google Play Services and your device's maps and dialler applications. Their own terms apply to your use of them. We are not responsible for their availability, accuracy or conduct.

12. Disclaimers

The Platform is provided on an “as is” and “as available” basis. To the maximum extent permitted by law we disclaim all warranties, express or implied, including merchantability, fitness for a particular purpose and non-infringement. We do not warrant that the Platform will be uninterrupted, error-free or secure, or that delivery estimates will always be met.

Nothing in these Terms limits your rights as a consumer under the Consumer Protection Act, 2019 or any other law that cannot legally be excluded.

13. Limitation of liability

To the maximum extent permitted by law, Milcko and its directors, employees and partners will not be liable for indirect, incidental, special, punitive or consequential losses, or loss of profit, data or goodwill, arising from your use of the Platform. Our total aggregate liability for any claim is limited to the value of the order giving rise to that claim, or ₹1,000, whichever is higher.

14. Indemnity

You agree to indemnify and hold Milcko harmless from any claim, loss, liability or expense (including reasonable legal fees) arising out of your breach of these Terms, your misuse of the Platform, or your violation of any law or third-party right.

15. Suspension and termination

We may suspend or terminate your account, with or without notice, if you breach these Terms, if we suspect fraud or abuse, or if required by law. You may stop using Milcko at any time and delete your account via the account deletion page. Amounts already due remain payable, and clauses that by their nature should survive termination will do so.

16. Governing law and dispute resolution

These Terms are governed by the laws of India. Any dispute will be subject to the exclusive jurisdiction of the competent courts at Bhopal, Madhya Pradesh. Before litigation, both parties agree to attempt resolution in good faith — write to us first at milckoofficial@gmail.com and we will respond within 30 days.

17. Changes to these Terms

We may revise these Terms from time to time. The updated version takes effect when posted on this page, and we will notify you in the app for material changes. Continuing to use Milcko after that means you accept the revised Terms.
